A Few New Motoring Laws We Should Be Aware Of
|
In California, the legislative landscape is continually evolving, particularly concerning the California Vehicle Code and vehicle operations. Each year, numerous new laws are enacted that can significantly affect drivers throughout the state, including those in our city. This year, changes have been introduced that I found are particularly relevant for our motorists.

The Daylighting Law: Assembly Bill 413 (AB 413) prohibits the stopping, standing, or parking of a vehicle within 20 feet of the vehicle approach side of any unmarked or marked crosswalk or 15 feet of any crosswalk where a curb extension is present.
|
Comment: This law prohibiting parking within 20 feet of both marked and unmarked crosswalks is a significant step towards enhancing pedestrian safety. This initiative aims to improve visibility for pedestrians, allowing them to be seen more easily by drivers, which can significantly reduce the likelihood of accidents occurring at crosswalks. By implementing this rule, authorities are prioritizing the safety of vulnerable road users and fostering a more pedestrian-friendly environment. It is essential for drivers to comply with these regulations not only to avoid fines but also to contribute positively to road safety for everyone.

This bill was signed by the Governor on October 10, 2023 and took effect on January 1, 2025.

Protect California Drivers Act: Senate Bill 1107 (SB 1107) doubled the current minimum auto liability limits. The old minimum of $15,000 per claimant and $30,000 per occurrence for bodily injury, and $5,000 for property damage, increased to $30,000 per claimant, $60,000 per occurrence for bodily injury, and $15,000 for property damage.

Comment: The law pertains to the inadequacy of current liability coverage in relation to the rising costs associated with medical care and automobile repairs. In many instances, victims of automobile accidents find themselves financially burdened, as they are compelled to cover a significant portion of their expenses out-of-pocket due to insufficient insurance coverage.
|
In response to these challenges, recent legislation has been introduced aimed at addressing the gap in liability levels. One notable consequence of this legislative change is the increase in insurance premiums for drivers who previously maintained only minimum coverage policies. As of January 1, 2025, these drivers will experience higher premiums as insurers adjust their rates to reflect the increased financial risks associated with higher medical and repair costs.

This adjustment serves not only to protect the interests of accident victims but also to ensure that insurance policies provide adequate support in the event of an accident, thereby fostering a more equitable system for all road users
|
- Liability for single injury or death – from $15,000 to $30,000.
- Liability per accident – from $30,000 to $60,000.
- Property damage – from $5,000 to $15,000.
This bill was signed by the Governor on September 28, 2022 and took effect January 1, 2025.

License Plate Manipulation Bill: Assembly Bill 2111 (AB 2111) prohibits any alteration of a license plate’s reflective coating to avoid detection from any entity, not just law enforcement.
|
Comment: The new law significantly expands the scope of regulations concerning license plate visibility and obstruction. Previously, the law specifically targeted alterations to a license plate's reflective coating to evade law enforcement detection. However, under the new law, this prohibition has been broadened to encompass any actions that obscure a license plate's visibility, irrespective of whether the entity attempting to capture the plate information is law enforcement or another organization.

This enhancement means that enforcement mechanisms now extend beyond traditional police surveillance to include automated systems such as toll road cameras, traffic signal monitoring devices, and surveillance in parking facilities. Furthermore, AB 2111 explicitly addresses vendors who sell products designed to obscure license plates, holding them accountable for contributing to violations of this law.

Overall, AB 2111 aims to improve public safety and accountability by ensuring that license plates remain visible and identifiable in all circumstances. This bill was signed by the Governor on July 2, 2024 and took effect July 2, 2024.

Driver Monitoring Defeat Devices Bill: Senate Bill 1313 (SB 1313) prohibits vehicles from being equipped with a device that is specifically designed, marketed, or being used to neutralize, disable, or interfering with a driver monitoring system that is engaged when drivers are utilizing advanced driver assistance system features or autonomous technology.

Comment: The new law aims to enhance road safety by addressing the critical issue of drivers circumventing their vehicle's driver monitoring systems while the vehicle is in motion. This is particularly relevant for vehicles equipped with advanced driver-assistance systems (ADAS) or autonomous technologies, which rely on these monitoring systems to ensure that drivers remain attentive and engaged.

A common tactic employed by some drivers involves using steering wheel weights to simulate the presence of hands on the steering wheel. This deceptive practice undermines the safety mechanisms intended to monitor driver alertness and can lead to dangerous situations on the road. By implementing this law, authorities seek to deter such behavior, thereby reinforcing the importance of driver vigilance and enhancing overall vehicular safety.

In summary, this legislation represents a proactive step towards mitigating risks associated with advanced vehicle technologies and ensuring that drivers adhere to necessary safety protocols.
